Terms and Conditions

Effective Date: 3 August 2026

1. Introduction

These Terms and Conditions govern the provision of environmental consulting services by Clear Ground Services ("we", "our", or "us") to our clients ("you" or "the Client").

By accepting a quotation, engaging our services, or instructing us to commence work, you agree to these Terms and Conditions.


2. Services

Clear Ground Services provides professional environmental consulting services, including but not limited to:

  • Environmental assessments

  • Site inspections

  • Environmental management advice

  • Compliance and regulatory consulting

  • Environmental reporting

  • Project support and specialist consulting

The scope of each project will be detailed in the accepted quotation, proposal or service agreement.


3. Quotations

All quotations:

  • are valid for 30 days unless otherwise stated;

  • are based on the information provided by the Client;

  • may be revised where project requirements change.

A quotation becomes binding once accepted in writing, by email, by signing the quotation, or by instructing us to commence work.


4. Scope Changes

Any additional work requested outside the agreed scope will be treated as a variation.

Variations may result in additional fees and revised completion timeframes.

No variation will be undertaken until approved by the Client unless immediate action is reasonably required to protect health, safety or the environment.


5. Client Responsibilities

The Client agrees to:

  • provide accurate and complete project information;

  • provide safe and lawful access to project sites;

  • obtain any required permissions for site access;

  • cooperate with reasonable requests for information;

  • promptly review and approve reports where required.

Delays caused by the Client may affect project schedules and pricing.


6. Fees and Payment

Unless otherwise agreed:

  • invoices are payable within 14 days of issue;

  • GST will be charged where applicable;

  • progress payments may be required for larger projects;

  • interest may be charged on overdue accounts at the maximum rate permitted by law.

The Client is responsible for reasonable debt recovery costs associated with overdue accounts.


7. Project Timeframes

Estimated completion dates are provided in good faith.

Completion dates may be affected by:

  • weather conditions;

  • regulatory approval timeframes;

  • access restrictions;

  • delays in receiving information from the Client;

  • circumstances beyond our reasonable control.


8. Reports and Professional Advice

Reports are prepared for the specific Client, project and purpose identified in our proposal.

Unless expressly agreed:

  • reports must not be relied upon for other projects;

  • reports must not be altered;

  • reports must not be reproduced except in full;

  • third parties may not rely upon our reports without our written consent.

Professional opinions are based on information available at the time of assessment.


9. Intellectual Property

Unless otherwise agreed in writing:

  • Clear Ground Services retains ownership of all intellectual property developed during the engagement;

  • upon full payment, the Client receives a non-exclusive licence to use reports and deliverables solely for the intended project.

Templates, methodologies, calculations and internal systems remain our intellectual property.


10. Confidentiality

Both parties agree to keep confidential any proprietary or commercially sensitive information obtained during the engagement unless disclosure is required by law.


11. Limitation of Liability

To the maximum extent permitted by law:

  • our liability is limited to the value of the services supplied;

  • we are not liable for indirect, consequential or economic loss;

  • we are not responsible for decisions made by third parties, regulators or authorities.

Nothing in these Terms excludes rights that cannot legally be excluded under Australian Consumer Law.


12. Site Conditions

Environmental conditions may vary over time.

Our findings are based on conditions observed during the assessment and information available at that time.

We cannot guarantee future environmental conditions or outcomes.


13. Force Majeure

We are not liable for delays or failure to perform services caused by events beyond our reasonable control, including natural disasters, extreme weather, industrial action, government action or utility failures.


14. Cancellation

The Client may cancel services by providing written notice.

Where work has commenced, the Client remains responsible for:

  • work completed;

  • committed subcontractor costs;

  • non-refundable expenses;

  • administrative costs reasonably incurred.


15. Privacy

Personal information is handled in accordance with our Privacy Policy.

Information collected may be used to provide services, communicate with clients and meet legal obligations.


16. Website

Information published on our website is provided for general information only and does not constitute professional environmental advice.


17. Governing Law

These Terms and Conditions are governed by the laws of the State or Territory in which Clear Ground Services operates and the laws of the Commonwealth of Australia.

Any disputes shall be subject to the jurisdiction of the appropriate Australian courts.
